- NYC Statutory Residency — the 183-Day Rule: A taxpayer who maintains a permanent place of abode in New York City and is physically present for 184 or more days in a calendar year is taxed as a NYC resident on worldwide income. This applies regardless of where the actual domicile is located. The 183-day count is unforgiving — partial days count as full days, and the burden of proof is on the taxpayer. We handle the documentation and substantive analysis required to defend non-residency, including the "permanent place of abode" analysis that turned in cases like Gaied.
- Convenience-of-the-Employer Rule: New York's convenience-of-the-employer rule treats wages earned by a non-resident remote worker as NY-source if the work is performed remotely "for the employee's convenience" rather than the employer's necessity. This rule is responsible for an enormous amount of NJ-NY commuter overpayment and the corresponding refund opportunity for taxpayers who can document a true necessity-based remote-work arrangement.
- NYC Unincorporated Business Tax (UBT): Single-member LLCs and partnerships operating in NYC pay UBT (4% on net business income) in addition to NY State and federal tax. Sole-proprietor freelancers and gig workers operating from a Manhattan, Brooklyn, or Queens address are often unaware of UBT until they receive a notice. Entity-structure decisions (S-Corp election, LLC vs. corporation) interact directly with UBT exposure.
- NY Pass-Through Entity Tax (PTET) Election: New York's PTET election lets pass-through entities pay state tax at the entity level — deductible federally — while providing a state credit to owners. The election is annual and the deadline is March 15. The math must be run before electing, because for owners with significant out-of-state income, the election can backfire. - NY Estate Tax Cliff: New York imposes an estate tax that phases in at the federal exemption threshold (currently around $7.16 million for NY). Critically, once the estate exceeds 105% of that threshold, the tax becomes payable on the entire estate — not just the excess.
